How Federal and State Laws Protect Employees from Discrimination
Pennsylvania employees are protected by both federal law and state law, and understanding the difference matters. Below is a non-exhaustive list of federal anti-discrimination laws.
Federal Law
- Title VII of the Civil Rights Act of 1964 prohibits discrimination based on race, color, religion, sex, and national origin. It applies to employers with 15 or more employees.
- The Age Discrimination in Employment Act (ADEA) protects workers age 40 and older from age-based discrimination at employers with 20 or more employees.
- The Americans with Disabilities Act (ADA) prohibits discrimination against qualified individuals with disabilities and requires employers with 15 or more employees to provide reasonable accommodations.
- The Pregnancy Discrimination Act (PDA) and the Pregnant Workers Fairness Act (PWFA) protect pregnant employees and those with pregnancy-related conditions at employers with 15 or more employees
Pennsylvania Law
The Pennsylvania Human Relations Act (PHRA) mirrors many federal protections but applies to employers with four or more employees, a lower threshold that catches more Pittsburgh-area employers. The PHRA is enforced by the Pennsylvania Human Relations Commission (PHRC).
